ChatBack — Terms of Service

1. Acceptance of Terms

By downloading, installing, or using ChatBack (“the Software”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Software.

2. Description of Service

ChatBack is a local data portability tool that enables you to export your own AI conversation history from supported platforms (currently Google Gemini) into standard file formats (Markdown, Word DOCX, PDF).

ChatBack operates entirely on your local device. It is not a cloud service, SaaS platform, or online application.

3. Your Responsibilities

By using ChatBack, you represent and agree that:

3.1 Account Ownership

You will only use ChatBack to access and export conversations from accounts that you own or are authorized to access. Accessing another person’s account without their explicit consent is prohibited and may violate applicable law.

3.2 Lawful Use

You will use ChatBack in compliance with all applicable laws and regulations, including but not limited to:

  • The terms of service of the AI platform(s) you are exporting from
  • Data protection regulations (GDPR, CCPA, etc.)
  • Computer fraud and abuse laws in your jurisdiction

3.3 Personal & Archival Use

ChatBack is intended for personal data portability and archival purposes. You are responsible for how you use, store, share, or publish your exported conversations.

3.4 No Malicious Use

You will not use ChatBack to:

  • Access accounts you do not own or are not authorized to use
  • Circumvent security measures or access controls
  • Harvest data from other users’ accounts
  • Conduct automated mass data collection beyond your own personal conversations
  • Engage in any activity that violates the rights of others

4. License

4.1 Demo Mode

ChatBack may be used in Demo Mode (limited functionality) without a license key, free of charge, for evaluation purposes.

4.2 Pro License

A valid license key is required for full functionality. License keys are:

  • Non-transferable — bound to the purchasing individual or entity
  • Per-device — may be activated on a reasonable number of personal devices (up to 3)
  • Perpetual for the purchased version — includes 1 year of free updates from the date of purchase

4.3 License Validation

The Software periodically validates your license key against our licensing service (LemonSqueezy). An internet connection is required at least once every 30 days for validation. The Software will continue to function offline for up to 30 days between validations.

4.4 Restrictions

You may not:

  • Share, redistribute, or resell your license key
  • Reverse-engineer, decompile, or disassemble the Software (except where permitted by applicable law)
  • Remove, alter, or obscure any license notices or proprietary markings
  • Use the Software to operate a competing service

5. Intellectual Property

5.1 Software Ownership

ChatBack and all related intellectual property are owned by Parabolic Holding AS. These Terms grant you a limited license to use the Software — not ownership.

5.2 Your Content

Your exported conversations are your property. We make no claim of ownership, license, or intellectual property rights over any content you export using ChatBack. We never access, read, or process your content — it exists only on your device.

6. Third-Party Platforms

6.1 No Affiliation

ChatBack is not affiliated with, endorsed by, or partnered with Google LLC, Alphabet Inc., OpenAI, Anthropic, xAI, or any other AI service provider.

6.2 Platform Terms

Your use of third-party AI platforms (e.g., Google Gemini) is governed by those platforms’ own terms of service. It is your responsibility to review and comply with those terms.

6.3 Platform Changes

AI platforms may change their interface, structure, or access methods at any time without notice. ChatBack’s extraction operates on a best-effort basis and cannot guarantee uninterrupted compatibility, complete accuracy, or 100% message recovery from any third-party platform. We will make commercially reasonable efforts to release updates promptly when such changes are detected.

7. Data & Privacy

ChatBack collects no personal data. Please refer to our Privacy Policy for complete details.

In summary:

  • No telemetry, analytics, or crash reporting
  • No cloud storage or data transmission (except license validation)
  • All conversation data stays on your local device
  • Your Google credentials are handled by Google’s own login page

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Software will be error-free or uninterrupted
  • The Software will be compatible with all third-party platforms at all times
  • Exported content will be a perfect reproduction of the source material
  • That every message, image, or formatting element in a conversation will be captured with 100% fidelity
  • The Software will meet your specific requirements

9. Limitation of Liability

9.1 General Limitation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PARABOLIC HOLDING AS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE.

9.2 Maximum Liability

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE LICENSE IN THE 12 MONTHS PRECEDING THE CLAIM.

9.3 Platform Actions

We are not liable for any actions taken by third-party platforms (e.g., Google) in response to your use of ChatBack, including but not limited to account suspension, service termination, or data deletion.

10. Indemnification

You agree to indemnify and hold harmless Parabolic Holding AS from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from:

  • Your use of the Software
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your exported content and how you use it

11. Refund Policy

If ChatBack does not function as described on your system, you may request a refund within 7 days of purchase by contacting us with a description of the issue. Refunds are granted at our discretion for legitimate technical problems.

The free Demo Mode exists specifically so you can verify that ChatBack works with your account and system before purchasing. By purchasing a license, you acknowledge that you have had the opportunity to evaluate the Software’s functionality.

Refund requests are processed through LemonSqueezy. Upon refund, your license key is automatically deactivated.

EU/EEA consumers: By downloading and using the Software, you consent to the immediate delivery of digital content and acknowledge that this waives your 14-day right of withdrawal under the Consumer Rights Directive (2011/83/EU), as permitted by Article 16(m).

12. Termination

12.1 By You

You may stop using ChatBack at any time by uninstalling the Software and deleting all associated files.

12.2 By Us

We may revoke your license if you materially breach these Terms. In such case, you must cease using the Software and destroy all copies.

12.3 Survival

Sections 5 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), and 10 (Indemnification) survive termination.

13. Updates & Modifications

13.1 Software Updates

We may release updates to the Software at our discretion. Updates within your license period are provided at no additional cost.

13.2 Terms Updates

We may modify these Terms at any time. Continued use of the Software after changes constitutes acceptance of the modified Terms. Material changes will be announced via the Software or on our website.

14. Governing Law & Disputes

These Terms are governed by the laws of the Kingdom of Norway. Any disputes shall be resolved in the courts of [City, Norway].

For EU consumers: You retain any mandatory consumer protection rights granted by the law of your country of residence, regardless of the governing law clause above.

15. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Parabolic Holding AS regarding your use of ChatBack.
