Clear legal framework on how ChatBack operates as your personal User-Agent under international data portability standards.

1. The Fundamental Right to Data Portability

Under GDPR Article 20 (Right to data portability) in the European Union and the European Economic Area (EEA), individuals have the explicit legal right to receive personal data concerning them in a structured, commonly used, and machine-readable format. Similar personal data access and portability rights are established under the California Consumer Privacy Act (CCPA) and modern global privacy frameworks.

2. The Automated User-Agent Doctrine (Sony Betamax Principle)

ChatBack operates under the well-established legal doctrine of an Automated Personal User-Agent:

  • User-Directed Execution: ChatBack runs solely on your local computer hardware and executes exclusively upon your explicit instructions.
  • No Intermediary Servers: ChatBack does not route, intercept, proxy, or relay your requests or data through any external servers or proxies.
  • Format Shifting & Private Archival: Under the legal principles established in Sony Corp. of America v. Universal City Studios (the Betamax doctrine), utilizing local consumer software to archive, time-shift, and format-shift content that you are legitimately authorized to view for personal archival purposes is lawful non-infringing fair use.

3. Direct Personal Authentication

ChatBack does not bypass authentication safeguards or reverse-engineer private server-side APIs:

  • You authenticate directly with the service provider (e.g., Google) via an integrated local Chromium browser session.
  • Your credentials and passwords are submitted directly to the service provider's servers; ChatBack never sees, captures, or records your passwords.
  • Session cookies remain isolated in your local application directory and are never transmitted to Parabolic Holding AS or third parties.

4. Data Ownership & Responsibility

You remain the sole owner of your exported conversation archives. ChatBack provides the local conversion utility to format your conversations into standard Markdown (.md), Microsoft Word (.docx), and .pdf documents on your local storage drive.
